Several states protect water-wise lawns
A growing number of states limit an HOA’s power to ban drought-tolerant or water-conserving landscaping. In Texas, for example, Property Code §202.007 prohibits an HOA from restricting water-conserving landscaping and bars it from unreasonably rejecting such a plan on aesthetic grounds. Colorado has similar protections — per Colorado State University, a 2019 law stops HOAs banning xeriscaping and a 2023 law requires HOAs to offer approved water-wise designs.
Crucially, these laws still let an HOA require neatness, edging, pre-approval and a maintained appearance — they stop a turf mandate, not all oversight. A well-prepared, tidy plan is what wins approval.

1. Read your CC&Rs. Find the exact provision and the architectural-review process.
2. Check your state law. Confirm whether your state protects water-wise landscaping (and cite the statute if it does).
3. Design for “intentional,” not “wild.” Clean borders, defined beds and a maintenance plan address the real concern: tidiness.
4. Document the water savings. Frame the conversion as conservation, which is what the laws protect.
5. Submit for pre-approval. Never tear out turf before you have written approval.
